In a reprieve for those who had
challenged the allotment of industrial plots in different sectors of Faridabad
and Gurgaon, the Punjab and Haryana High Court has cancelled the orders of
Haryana Urban Development Authority (HUDA), wherein it had cancelled allotment
made to several individuals.
The court has directed the chief
administrator of the HUDA to personally intervene in the matter and consider
the reports of collectors of the districts.
The directions were passed in
wake of a bunch of petitions filed by residents of Faridabad and Gurgaon, who
had challenged the allotment of industrial plots made by Haryana government in
Gurgaon and Faridabad in 2004.
The petitioners had alleged that
without giving any basis for rejection, HUDA had cancelled their allotment of
plots. Upholding the contentions raised by the petitioners, the high court
observed: "We are of the view that all such allottee who have been offered
allotments be allowed to retain the same on payment of market price of the
industrial plots calculated with reference to the date of allotment. In making
the aforesaid calculation, the Chief Administrator, Haryana Urban Development —
who will personally intervene in the matter — will go by the reports of the
collectors of the districts."
The Bench added: "In the
event the allottee are ready to pay the amount either in one installment or in
equated installments of reasonable numbers such reasonable numbers is
determined by the chief administrator."
The court has asked the
Administrator to take action within six months.
